New legislation coming after court strikes down Alberta impaired driving law

Aug 16, 2017 | 7:12 PM

Alberta’s justice minister says she’ll bring in new legislation after the courts struck down part of the province’s drunk-driving law.

The Alberta Court of Appeal ruled in May that a provision allowing authorities to suspend the licences of suspected drunk drivers until their cases are resolved disregards the presumption of innocence.

Defendants in the appeal argued the law was leading some innocent people to plead guilty just to get their licences back.

Justice Minister Kathleen Ganley says the province will not appeal the ruling.
